If the equipment is down for more than 24 consecutive hours due to repairs not caused by Customer use, AER, at its option, will issue credit or replace with similar equipment mutually agreed upon, or will terminate the rental agreement and credit accordingly. 2. Make all repairs on equipment, except items caused by a)customer negligence b) those items (6) and (7) which customer has agreed to provide or c) items excluded from the limited physical damage coverage. 3. Provide equipment in good operating condition and supply all manuals necessary for customer to properly operate and maintain equipment.Customer Agrees… 1. Rental payments are due in advance unless prior credit is approved. 2. Advanced Equipment Rental (AER) is not responsible for natural occurrences (i.e. rain,snow,etc.) or other events out of AER's control and no credit will be issued because of these occurrences. 3. To provide liability and property damage insurance of sufficient amount to cover all reasonable exposure. AER may ask for a certificate of insurance which Customer agrees to provide. 4.To accept the limited physical damage waiver if Customer does not provide a certificate of insurance for sufficient amount to cover all reasonable exposure. 5. Where permitted by law, to accept all liability for any injury or risk of damage and loss upon taking possession of equipment except to extent covered by limited physical damage waiver with a deductible as indicated above. 6. To be responsible for operation daily lubrication and maintenance as specified in the operation and Maintenance Manuals. 7. To provide all wearable supplies such as ground engaging tools, fuel, oil, filters, etc. 8. To replace broken glass, make adjustments for damaged tires, bent steps, hand rails, cat walks, fenders, sheet metal and all other damage other than normal wear, except to extent covered by the limited physical damage waiver with a deductible as indicated above. 9. Notify AER immediately of a) any mechanical failure, at which time judgment will be made on who is responsible: b) any change in agreed location: c) any planned modification to the equipment: d) an inoperative hour meter: e) any damage to property or bodily injury immediately upon discovery. 10.Not to sublease, rent or load the equipment or grant a security interest therein. 11. To allow AER inspection of unit at any time. 12. To pay a clean up charge for excessively dirty equipment. 13. To pay for transportation and disassembly or assembly of unit if needed. 14. To return the equipment to nearest AER yard, unless otherwise agreed. 15. Rental rate begins when the equipment leaves AER's yard and ends when it returns. 16. Agrees to indemnify and hold harmless AER from any claims or proceedings caused by Customer use or possession of equipment, including but not limited to attorney fees and costs of court.
